Welcome to Pay4Pixels (Operated by Allatt Tech Solutions Inc.) (the "Platform"). By accessing or using this Platform, you agree to comply with and be bound by the following Terms of Use. If you do not agree to these terms, please do not use the Platform.

1. Acceptance of Terms

By using the Platform, you confirm that you are at least 18 years old or have the legal capacity to enter into a binding agreement. These Terms of Use govern your use of the Platform and all services provided by Pay4Pixels ("we," "us," or "our").

2. Platform Services

The Platform is an online marketplace that allows merchants ("Sellers") to list and sell digital vouchers, in-game tokens, digital goods, and physical goods to customers ("Buyers"). We provide the Platform as an intermediary and do not own or sell the products listed by Sellers. Pay4Pixels provides marketplace, technical, and payment-facilitation services and does not operate the seller's game or service, issue the seller's virtual points, or represent that the seller is affiliated with or authorized by any third-party game publisher.

3. User Accounts

• You must create an account to use certain features of the Platform.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• You agree to provide accurate and complete information during registration and to update it as necessary.

4. Seller Obligations

• Each seller is the merchant and sole contracting party for products sold through its storefront. The seller, and not Pay4Pixels, determines the product offering, issues and delivers any virtual points, establishes applicable product terms, and is responsible for the legality, authorization, fulfilment, support, refunds, taxes, and regulatory compliance associated with the product.
• Sellers are responsible for the accuracy, quality, and legality of the digital products they list.
• Sellers must comply with all applicable laws, including consumer protection, digital product delivery, and intellectual property laws.
• Sellers are responsible for fulfilling digital orders and resolving disputes with Buyers.

5. Buyer Obligations

• Buyers are responsible for reading digital product descriptions, reviews, and policies before making a purchase.
• Buyers must provide accurate payment information.

6. Prohibited Activities

• Use the Platform for any illegal or unauthorized purpose.
• Violate any laws, including but not limited to intellectual property laws.
• Interfere with the operation of the Platform or its security features.
• Engage in fraudulent activities, including fake reviews or transactions.

7. Fees and Payments

• Sellers may be charged fees for listing digital products or using additional services.
• Buyers are responsible for paying the total price of digital products. Buyers and Sellers are responsible for determining and remitting any applicable taxes in their jurisdiction.
• All payments are processed through secure third-party payment gateways.

8. Intellectual Property

• All content on the Platform, including logos, text, and images, is owned by Pay4Pixels or its licensors and is protected by intellectual property laws.
• Sellers retain ownership of the content they upload but grant us a license to use it for Platform operations.
• Each seller represents that it possesses all rights and permissions required to offer its products.
• Pay4Pixels may suspend listings, transactions, or services upon receiving a credible intellectual-property complaint or where Pay4Pixels reasonably believes continued service would violate applicable law or third-party rights.

9. Limitation of Liability

• We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform.
• Our liability is limited to the maximum extent permitted by law.

10. Termination

We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without notice, for any violation of these Terms of Use.

11. Governing Law

These Terms of Use are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.

For Buyers, any dispute arising under or in connection with these Terms of Use shall be resolved by the courts of Ontario, Canada.

For Sellers, dispute resolution is governed by the Merchant Agreement between the Seller and Pay4Pixels, which requires binding arbitration seated in Toronto, Ontario and contains a class-action waiver. Where a Seller has entered into a Merchant Agreement, the dispute-resolution and governing-law provisions of that Merchant Agreement control over this Section to the extent of any conflict.

12. Virtual Points & In-Game Currency

• Certain products sold on the Platform are classified as "Virtual Points," "in-game tokens," "in-game currency," or similar digital items (collectively, "Virtual Points"). Virtual Points are licensed, not sold, and represent a limited right to access specific in-game features or content within the designated game or application for which they are issued.
• Virtual Points have no real-world monetary value, are not redeemable for cash, cryptocurrency, or any other form of legal tender, and cannot be exchanged, transferred, sold, or traded outside the designated game or application.
• Virtual Points do not constitute and shall not be construed as: (a) a stored-value product, e-money, or prepaid access instrument; (b) a digital currency, virtual currency, or cryptocurrency; (c) a security, commodity, or financial instrument of any kind; or (d) any form of deposit, investment, or financial product regulated under applicable banking, securities, or money transmission laws.
• All purchases of Virtual Points are final and non-refundable. The issuing game operator or Seller retains the right to modify, suspend, or discontinue Virtual Points at any time without prior notice or compensation.
• By purchasing Virtual Points, you acknowledge that you are acquiring a limited license to use digital content within a specific game environment and that no ownership, proprietary, or monetary interest is being conveyed.

13. Changes to Terms

We may update these Terms of Use from time to time. Your continued use of the Platform constitutes acceptance of the revised terms.

Compliance Policy for Digital Products

1. Introduction

At Pay4pixels.com, we are committed to providing high-quality digital products and ensuring a seamless and satisfactory experience for our customers. This Compliance Policy outlines the terms and conditions governing the purchase, use, and non-returnability of our digital products. By accessing or using our website and purchasing our digital products, you agree to comply with this policy.

2. Definition of Digital Products

Digital products refer to any software, e-books, online courses, digital media, or other intangible goods that are delivered electronically and are accessible to customers upon purchase. These products are designed to be used immediately after purchase and are not subject to physical return or refund.

3. Non-Returnable Nature of Digital Products

Digital products, by their nature, are non-returnable and non-refundable once they have been accessed or used by the customer. This policy is in place to protect the intellectual property rights of Pay4pixels.com and to ensure that our products are not subject to unauthorized distribution or misuse. Upon purchase, you will receive access to the digital product, and any use or access to the product constitutes acceptance of this non-returnable policy. This non-returnable policy applies only to digital products. Physical goods are subject to separate return, refund, and consumer-withdrawal rights as described below and in the applicable Refund and Delivery & Shipping policies.

4. Exceptions to Non-Returnability

• The product is found to be defective or not functioning as described.
• There is a proven issue with the delivery of the product that is not attributable to the customer.
• The customer has not accessed or used the product and can provide proof of purchase.

5. Physical Goods

Physical goods sold on the Platform are subject to the Seller's stated returns and warranty policy and to applicable consumer-protection law. Where the Buyer is a consumer in the EU, EEA, or United Kingdom, the Buyer has a 14-day right of withdrawal that runs from the day the Buyer (or a person they nominate) takes physical possession of the goods, subject to legal exceptions (for example, custom-made or personalized goods, perishable goods, and sealed goods unsealed after delivery for health or hygiene reasons). To exercise this right, the Buyer should contact the Seller or Pay4Pixels support.

7. Intellectual Property Rights

All digital products provided by Pay4pixels.com are protected by copyright and other intellectual property laws. Customers are granted a limited, non-transferable license to use the digital products for their personal or intended purpose only.

8. Compliance with Laws and Regulations

Customers agree to use digital products in compliance with all applicable laws. Pay4pixels.com reserves the right to terminate access for violations.
